Abstract

This paper proposes a methodology that combines ex–ante and ex–post analysis regarding the effectiveness of the supervisory mechanisms of the International Labour Organization. It argues the need to consider the interests that employers' and workers' organizations have in resorting to this international institutional framework to resolve labour disputes.

The ex–ante and ex–post approach prevents studies from focusing exclusively on the legal effects that supervisory bodies' pronouncements have in domestic legal framework.

This paper uses Power Resources Theory in its analysis. Consequently, it is possible to understand ILO supervisory system as a political-institutional resource of power.

One advantage of this methodology is, not only to strengthen the study of the ILO's supervisory effectiveness, but also to introduce new elements into the debate on the organization's legitimacy. In this regard, Latin American and Caribbean context provides valuable insights regarding the pathways required to achieve the objectives that the ILO has set for itself.
